2. The existing 0.06 acres of wetlands to be filled by the proposed road crossing will be restored after <br />the road crossing has been removed. <br />3. All debris, which includes concrete rubble and metal that exists in the stream and wetlands at the <br />proposed road crossing shall be removed from the stream and wetlands when the road crossing is <br />removed. <br />4. A mitigation monitoring report must be sent to this office prior to December 31of each year, after <br />this work has been authorized, until the Corps of Engineers determines that 0.06 acres of created <br />wetlands, which were filled by the road crossing has been successfully mitigated on site (if the 0.06 <br />acres of wetlands were not purchased from an approved wetland mitigation bank} and once the road <br />crossing has been removed, the 0.06 acre of filled wetlands has been successfully restored. <br />Although an Individual Department of the Army permit will not be required for this project, this does not <br />eliminate the requirement that any other applicable Federal, state, tribal or local permits be obtained as required. <br />Please be advised that deviations from the original plans and specifications of this project could require <br />additional authorization from this office. <br />The applicant is responsible for all work accomplished in accordance with the terms and conditions of <br />the nationwide permit. If a contractor or other authorized representative will be accomplishing the work <br />authorized by the nationwide permit on behalf of the applicant, it is strongly recommended that they be provided <br />a copy of this letter and the attached conditions so that they are aware of the limitations of the applicable <br />nationwide permit. Any activity which fails to comply with all the terms and conditions of the nationwide permit <br />will be considered unauthorized and subject to appropriate enforcement action. <br />This verification will be valid until Nlarch 26, 2006. In compliance with general Condition 14, the <br />attached "Certification of Completed Work" form (blue) must be signed and returned to this office upon <br />completion of the authorized work and any required mitigation. <br />The U.S. Fish and Wildlife Service (USFWS) has officially listed the Ute ladies' tresses orchid, <br />Sniranrhes dilnvialis, as a threatened plant species under the Endangered Species Act. This plant may occur in <br />seasonally moist sails and wet meadows near springs, lakes, or perennial streams and their associated flood plains <br />below 6,500 feet elevation in certain areas in Colorado. <br />Also, the USFWS has listed the Preble's meadow jumping mouse (Zapus hudsonius prebler) as a <br />Federal threatened species under the Endangered Species Act of 1973. This species occurs in or near stream <br />channels (perennial and intermittent), riparian habitats, floodplains, wetlands including wet meadows (both natural <br />and those created by seeps from man-made structures such as dams, irrigation canals, ditches, etc.) or, wet or mesic <br />native hayfield, in sites below 7,600 feet elevation in certain areas in Colorado. <br />Li order for a Department of the Army authorization to be valid for the proposed project, the Corps of <br />Engineers must ensure that the existence of these species or the habitats in which they are found will not be <br />jeopardized. Therefore, the USFWS has recommended that a survey for the plant species be conducted, and a <br />survey to determine the presence or absence of potential suitable habitat for the mouse in the project area. For the <br />mouse, if potential habitat is present, then a trapping survey must be conducted. <br />
