Ruch, wherein you <br />propose to settle the Division's civil claim against Wyoming Fuel <br />Company pursuant to section 33-6-110, C.R.S.(19841, by restocking <br />the affected section of the Purgatoire River. <br />First of all, I wish to advise that the Division of Wildlife <br />and this office do not agree with your interpretation of section <br />33-6-110 as requiring an intent to take wildlife as a prerequiste <br />to recovery of damages. We are prepared to litigate that issue if <br />an acceptable settlement cannot be reached. <br />I understand that Area Wildlife Manager Ron Velarde has already <br />advised you that your proposed restocking is not an acceptable <br />resolution of the Division's claim. However, we believe there are <br />bases upon which to settle the claim. Ron Velarde or District <br />Wildlife Manager Bob Holder will be contacting you to set up a <br />conference to discuss alternative proposals for settlement.
