Box 15596
Lakewood, CO 80215
Re: Purgatoire River Fish Kill
Dear Mr. Weston:
STATE SERVICES BUILDING
1525 Sherman Street
Denver, Colorado 80203
Phone 866-3611 8 866-3621
This letter will respond to your letter of April 14, 1988 to
Colorado Division of Wildlife Director James B. Ruch, wherein you
propose to settle the Division's civil claim against Wyoming Fuel
Company pursuant to section 33-6-110, C.R.S.(19841, by restocking
the affected section of the Purgatoire River.
First of all, I wish to advise that the Division of Wildlife
and this office do not agree with your interpretation of section
33-6-110 as requiring an intent to take wildlife as a prerequiste
to recovery of damages. We are prepared to litigate that issue if
an acceptable settlement cannot be reached.
I understand that Area Wildlife Manager Ron Velarde has already
advised you that your proposed restocking is not an acceptable
resolution of the Division's claim. However, we believe there are
bases upon which to settle the claim. Ron Velarde or District
Wildlife Manager Bob Holder will be contacting you to set up a
conference to discuss alternative proposals for settlement. Hope-
fully, one of them will be mutually acceptable.
Sincerely,
FOR THE ATTORNEY GENERAL
~`~
- 9.~~~
Lawrence A.
