M-90-021 <br />Oear Mr. McGehee: <br />We have reviewed the additional information you submitted in connection with <br />the above-referenced application on July 18, 1990. There are still several <br />outstanriing items which must be addressed before your application can be found <br />adequate to meet the requirements of the Act and Regulations, as described <br />below: <br />Mining Flan (Exhibit D) <br />1. Contrary to information which was originally submitted, your most recent <br />adequacy responses indicate that the project site is completely outside <br />of the 100-year flood plain limit. Based on this information, you have <br />rescinded a commitment to construct a protective berm on the south <br />boundary of the site, adjacent to the Colorado River. Please provide a <br />copy of the study, maps and other documentation upon which you base your <br />conclusion that you are outside of the flood plain. Also, please comment <br />on issues (bank stability; potential for flooding; etc.) raised by <br />objectors to your application in their letter dated September 5, 1990 <br />(copy enclosed). <br />Reclamation Costs (Exhibit L) <br />2. Please commit to providing Financial Warranty in the amount of E30,000 <br />prior to commencing operations. <br />This matter will be considered by the Board on September 19-20, 1990.
