B. 1065, The <br /> Denver and Rio Grande Western Railroad Company has been given notice that <br /> Nottingham Sand and Gravel Company, P. 0. Box B, Avon, Colorado 81620 on <br /> January 2, 1979 applied to the Colorado Tuned Reclamation Board for a permit <br /> to conduct sand and gravel mincing operations on lands located in parts of <br /> Section 1 and 2, T5S, R85W, 6th P.M. , Eagle County, Colorado. <br /> Our Ccmpany has had considerable correspondence with the Eagle County Planning <br /> Commission and the Eagle County Board of County Commissioners relative to <br /> applications made by Brush Creek and Eagle River Companyl Nottingham and their <br /> lessee Mountain Mobile Mix for a special use permit for a sand and gravel <br /> extraction operation and the following related uses of crushing, gravel washing, <br /> concrete batching, asphalt mixing, stabilizing unit muximng and precast manu- <br /> facturing operations. <br /> In our original letter to the Eagle County Plannine.Commission, we advised <br /> that the proposed mining operation is adjacent to our main line right of way <br /> kdhich runs betcaeen Denver and Salt lake City over Tennessee Pass and respect- <br /> fully requested that their application be subject to the following conditions <br /> so that the proposed sand and gravel operations would not adversely affect our <br /> track and right of way: <br /> (1) That the side wall of the proposed excavation be constructed on a slope <br /> of 1-� (horizontal) to 1 (vertical) , and so that no excavation nor effect <br /> therefrom shall encroach upon the Railroad's right of caay. <br />
