Dan Mathews <br />Colorado Mined Land Reclamation Division <br />423 Centennial Building <br />1313 Sherman Street <br />Denver, Colorado 80203 <br />Re: Response to Stipulations <br />Bear No. 3 Operation <br />Dear Dan: <br />Craig Springer of the Bear Coal Company and I appreciated the <br />opportunity to meet with you at the mine site on Plonday morning, Play 24, <br />1982. This letter will confirm the discussion at our meeting and <br />• contains responses to the stipulations given to Bear Coal Company. <br />The basic purpose of the meeting was to discuss the measures to be <br />undertaken by the Bear Coal Company in response to the stipulations <br />made on the approval to the permit. Although responses to all the <br />stipulations are included for your review and approval, the two <br />most critical stipulations to be approved are: <br />The drainage and sediment control plan as <br />submitted herein so that the Bear Coal Company can <br />initiate construction of the plan immediately upon <br />final approval of the permit. <br />The support structures far the stabi 1 ity of the portal <br />face-up area so that the bear Coal Company can <br />initiate construction of the necessary retaining wails <br />and related aspects upon final permit approval. <br />The following are the responses to the various stipulations to the <br />-Bear Coal Company permit approval included in the Proposed Decision and <br />Findings of Compliance Document of the Colorado Mined Land Reclamation <br />Division ("Division"): <br />Stipulation No. 1 <br />• In discussions previously held with Mr. Fred Banta and Mr. Dan Plathews <br />of the Division, representatives of the Bear Coal Company suggested that <br />a series of sediment control devices be utilized at the Bear No. 3 <br />
