• Dorchester granting rights to conduct surface coal mining operations <br />within 300 feet of the landowner's occupied dwelling is presented in <br />Exhibit 2, Ownership Information. This agreement has been assigned to <br />EFCI as provided for in the original terms. <br />2.03.8 PERMIT TERM INFORMATION <br />EFCI has submitted information within this application covering the entire <br />mine plan area encompassed by the permit boundaries. The anticipated <br />timetable for each phase of mining and reclamation over the life of the <br />mine and the anticipated number of acres to be affected are shown in Table <br />2, Affected Areas for Mining and Reclamation. The existing approved permit <br />expired on July 30, 1989. However, EFCI secured the right of successive <br />renewal by timely application for permit renewal. Application for a <br />second 5-year permit term under the existing permit has been filed, with <br />MLRD review and approval pending. <br />• This permit revision application is not intended to modify the term or <br />expiration date of the second permit term for which EFCI has already <br />submitted the renewal application discussed above. Since proposed mining <br />and reclamation operations will extend beyond the second 5-year permit <br />term, EFCI recognizes that future permit renewals will be required, and <br />has submitted information for the life of the Southfield Mine. <br />2.03.9 PERSONAL INJURY AND PROPERTY DAMAGE INSURANCE INFORMATION <br />A current certificate of insurance has been filed with the CMLRD and a <br />copy is included within this application as Exhibit 3, Certificate of <br />Insurance, as evidence that EFCI has a public liability insurance policy <br />in force for the Southfield Mine. The insurance policy meets regulatory <br />requirements for minimum coverage, will be maintained in full force <br />during the permit term and all subsequent renewals, and includes a rider <br />ensuring notification to the CMLRD of any termination or substantive <br />. changes in the policy. <br />2.03-39 <br />
