No permit limitation exceedences were reported during this period.
Quarterly Whole Effluent Toxicity (WET) tests were conducted for Outfall 001 beginning the week of November 26, 2001. Test
results indicated that the effluent was toxic to the survival of fathead minnows and C. dubia at concentrations greafer than 50%
effluent concentration. Thus, the site was not in compliance. On December 11, 2001, at the suggestion of Mr. Chris Gates of
CDPHE, TCC sent CDPHE a letter requesting relief from initiating accelerated or PTI/TIE testin°_ This request was based
upon an April 2001 TCC request to substitute a%u'Te~ETiesting or Daphnia magna only as opposed to chronic two species
testing. While CDPHE was considering this request, TCC initiated accelerated testing per current permit requirements. The
chronic accelerated test did not pass. In late December 2001, Mr. Gates left a message indicating relief would be granted. As
such, the_ n Win- ap_ ding rhrQaic WET test data has been entered mto the DMR, but has not been enterers an exceedence.
Copies of the CDPS WET Test Report Forms are included with this submittal.
In a subsequent conversation between myself and Mr. Gates in early January 2002, CDPHE asked that additional WET testing
be conducted, using the acute test for Daphnia magna only. A WET test sample was submiried to the laboratory on January
8, 2002. TCC has recently received these results. Unfortunately, this test indicated that the effluent was acutely toxic to
Daphnia magna. OuHall 001 has not been discharging since January 14, 2002 due to low flows on receiving creeks. TCC will
initiate accelerating tesTna as soon as oossbT.-Cop"Tes o e-fI~DPS acute WET Tesl Report Fonns are included with this
submittal. This latest data will be entered in the next quarterly DMR.
Please contact me directly at (970) 870-2750 for any questions.
Twentymile Coal Company
.~.t.~,f~. ~ ~~~n~~
Brian A.
