• Aquifers <br />Based on local conversation and past drilling, there are no known aquifers that will be <br />penetrated. There may be some incidental drilling into the very top of the Larimie -Fox <br />Hills depending on the depth below the lowest lignite seam and the geophysical probe <br />used. As the formation is unconfined, there is no expectation of any artesian flow from <br />such incidental exposure. <br />Method of Plugging Drill Holes <br />Holes will be sealed in compliance with 4.07.3. In general, the hole will be refilled with <br />cuttings or other suitable media up to 10 feet from the surface. Cement will be used to <br />fill the hole up to 3 feet from the surface and the remainder filled with drill cuttings. The <br />hole will be marked by a 12 inch rebar buried to 2" to 3" below the surface. <br />Transfer of Drill Holes to Surveillance Holes <br />There are no plans to modify any of the exploratory holes into water monitoring holes or <br />wells. <br />2.02.2(2)(h): Endangered or threatened species. <br />• Wildlife <br />Since the 2004 drill program, the area has been visited by District Wildlife <br />representatives. This NOI will be submitted by CDMG to the Colorado Division of <br />Wildlife for review and comment. Those comments and any correspondence will be <br />included as Exhibit H. <br />Cultural or Archeological Resources <br />For the 2005 program, KMG commissioned the Colorado Historical Society to conduct a <br />database search of eight sections along the south border of the 2004 program area. The <br />search resulted in no additional sites beyond those identified in 2004 Exhibit F . As in <br />2004, the exploration drill sites will be over 1000 feet distance from any indicated <br />cultural site. <br />2.02.7(1): Public availability of information. <br />A copy of this Notice of Intent will be forwarded to the County Clerk of Elbert County <br />upon acceptance by the Colorado Division of Minerals and Geology as a complete filing. <br />2.02.7(2): Confidentiality. <br />. None of the information in this Notice of Intent is considered confidential. <br />-11- <br />• ESTIMATION OF RECLAMATION COSTS <br />Exhibit G is a breakdown of the cost estimate for drill site reclamation. The assumptions <br />made are: <br />Drill holes filled in accordance with 4.07 and seed mix as shown in Exhibit D . No road <br />or drill pad construction.
