COG-850002 for the <br />Rianau No. 2 Mine on February 10, 1994, by latter to your consultant, Grog Lewicki 8e Associates. This <br />inactivation was granted hosed on information submitted by Mr. Lewicki in letters and on Division inactivation <br />forms. <br />A[ the time of this action, we had no information that indicated that a permit should still he required. However, <br />since that time we have received information from the Colorado Division of Minerals and Geology [hat a <br />sedimentation pond still exists on the site that may receive surface runoff tlow, in addition to groundwater inflow. <br />On the basis of potential for discharge of surface runoff from a post mining area, a CDPS permit is required. <br />Smote and federal permit regulations roquire an active permit for coal mining facilities until complete and final bond <br />release. Further, regulations state that a permit may he required after hood rCIe.95C if discharge or potential for <br />discharge of pollutants continue to exist. <br />We have enclosed a CDPS permit application for your convenience in reactivating coverage.
