You state that <br />these shares have been used to irrigate approximately 80 percent of the <br />369 acres in this application or 295 acres and that these shares cannot be <br />transferred to any other property. We would appreciate it if you could send <br />us a copy of the ditch company's by-laws and also identify the water rights <br />owned by the company as well as the number of shares outstanding. <br />Our records indicate that the Boyd Freeman Ditch is located near your <br />property and has been used to irrigate 250 acres the last two years. This may <br />be the water right that has been used on your property, <br />The method of replacing evaporation losses is unclear. Will the water <br />be left in the river at the headgate or will it be delivered to the gravel ponds <br />for augmentation? If the shares are transferable, then a method of permanently <br />attaching the shares to the property should be provided. Also, the yield per <br />share should be determined and only the number of shares necessary to replace <br />evaporation losses be incorporated in the plan. <br />
