On February 28, 2006, DMG approved the application for the Upper Animas Sand and Gravel
operation. The 5.9-acre permit area is located in portions of Section 31, T42N, R6W, NMPM,
San Juan County. During the review period DMG received an objection to the application from
Animas Rivers Stakeholders Group, and comments from US Army Corps of Engineers and
Bureau of Land Management.
Pursuant to Rule 1.4.11(1), any person who can demonstrate that he or she is directly and
adversely affected or aggrieved by DMG's approval decision, and whose interests are entitled to
legal protection under the Act may petition for a hearing before the Board. Such petition shall
state how the petitioner is directly and adversely affected or aggrieved by the approval decision,
and how the petitioner's interests are entitled to protection under the Act. The petition must
specify the permit number and must be received within 30 days of the approval date. Therefore,
such petition for the Upper Animas Sand and Gravel, Permit No. M-2005-065, must be received
by the Division no later than March 30, 2006.
