Long <br />Dimsion Direanr <br />Re: Agri-Cal #1, File No. M-97-064, Receipt of 110(2) Hard RocklMetal Mining Reclamation <br />Permit Application Package -Incomplete <br />Dear Mr. Vestal: <br />On August 29, 1997, the Division of Minerals and Geology received your the 110(2) Hard Rock/Metal <br />Mining Reclamation Permit Application package for the Agri-Cal #1, File No. M-97-064. Preliminary <br />review of the information received determined that the following items must be received before the <br />Division can consider your application as being submitted and technical review can begin: <br />I) EXHIBIT .i - Proof of Mailine Notices of Permit Application (Rule 6.3.101: Include proof <br />of mailings of the "Notice of Peraut Application" sent to the County Boazd of Commissioners <br />and Board of Supervisors of the local Soil Conservation District, in the application, by <br />submitting the date-stamped receipt for Certified Mailing or adate-stamped copy of the notice <br />form with signature acknowledging personal service and receipt by the appropriate board. Also, <br />refer to Rule 1.6.2(1)(a). The Soil Conservation District which you notified was the Fremont <br />County SCD, however, due to the location of this operation, you should have contacted the El <br />Paso SCD, which has jurisdiction to the 105° Meridian in Township 17. You are not required <br />to have them submit another SCD review unless they prefer to do so. You are only required to <br />notify them of, and provide a copy of your application. <br />I understand you have contacted the El Paso County SCD, 6y telephone, and inquired as to if <br />they wanted or needed a copy of your notifcation. Please be advised that regardless of their <br />desire to be notifed, it is our policy and requirement that the appropriate SCD Board of <br />Commissioners be notified of any new application or amendment in their area. See the enclosed <br />memo. !n order to meet these requirements, please notice the EI Paso County SCD as previously <br />requested, addressed to: El Paso County SCD Board of Commissioners, % Robert Cordova, <br />1826 East Platte Avenue Suite 114, Colorado Springs, CO 80909. Also, as yol[ were advised <br />previously, because of tke significa>':t change in your application, you are required to re-notify <br />the Fremont County Clerk and the Fremont County Commissioners. <br />
