Your letter described the pond as being
properly maintained and operated prior to the event and temperature charts were included demonsfrating a temperature
differential which resulted in snow melt during the sampling event. Sampling was conducted on December 3, 2002 at
approximately 9:30 a.m. at Outfa11002A. According to the temperature charts, the high was 48 degrees with a low of 23
degrees on December 3, 2002. Your sediment ponds aze designed to contain a 10-year/24-hour precipitation event. The self-
monitoring data you provided on your Discharge Monitoring Report is shown below:
Reported Pemrit
Period Outfall Parameter Results Conditions
4Q02 002A TSS (mgA) 50 (30 day avg) 35 (30 day avg)
4Q02 002A TSS (mg/1) 94 (daily nix) 70 (daily mx)
Trapper Mining has demonstrated that dischazge occurred within 48 hours after measurable temperature differentials,
resuhing in snow melt, and thus a dischazge from Outfall 002A was beyond your confroL Therefore, we believe that Trapper
Mining Company qualifies for the less than or equal to a 10-year/24-hour precipitation alternate limit, thus waiving total
suspended solids.
If you have any further questions regazding this matter, please contact me at (303) 692-3603.
Sinc rel , ~
Carla J.
