DANIELSON, DEPUTY STATE ENGINEER <br />SUBJECT: VALCO, INC. -CANON CTTY EAST PIT, FREMONT COUNTY, <br />APPLICATION FOR MINING AND RECLAMATION PERMIT <br />As requested by your office, we have reviewed the application for a gravel <br />pit near Canon City. We cannot recommend approval of this application until <br />the applicant provides the following additional information: <br />1. Page 7 states that "the working pits must be dewatered <br />during excavation..." . The applicant must calculate <br />the cone of depression created by dewatering in order <br />to determine the potential effects of dewatering on nearby <br />wells . <br />2. Page 19 states that some evaporation losses are expected <br />from the 21.14 acres of lake surface to be created by <br />mining. The application provides no plan to prevent this <br />evaporation loss from injuring water rights in the severely <br />over-appropriated Arkansas River basin. If the applicant's <br />ditch rights are sufficient to replace these losses, this <br />plan might permanently attach these rights to the land through <br />deed restrictions, protective covenants, or other legal means. <br />If these rights are insufficient, additional water rights may <br />be required to prevent injury. <br />J is A.
