"Buck" <br />Barnhart and concluded that two (2) concerns require resolution prior to approval of <br />your application for 1,970 permitted acres. <br />First, you must submit proof that all public notice requirements have been completed. <br />Second, I would like you to confirm whether groundwater will (or will not) be exposed <br />during the mining operation. <br />In the event that Baculite Mesa, LLC intends to extract minerals beneath an elevation <br />of 5,165 feet and risk exposure of groundwater, there will be several issues for you to <br />resolve, i.e., a) you will need to contact the State Engineer's Office where you may be <br />required to mitigate for evaporative loss; and b) the Division will request that you <br />submit an assessment of possible impacts to surface or groundwater, as well as a list <br />of measures to be implemented to minimize any possible impacts to surface or <br />groundwater sources, including the Nussbaum Spring. <br />I look forward to receiving your response on or before April 11, 1997. <br />Sincerely, <br />/f,~yuyiQ ..~ <br />i <br />Thomas A.
