CASTLE CONCRETE COMPANY'S <br />APPLICATION <br />SNYDER QUARRY <br />77-210 <br />LOCAL GOVERNMENT APPROVAL <br /> <br />Castle Concrete Company has a legally adjudicates. right to <br />mine within its 80 acre mining tract at the Snyder Quarry F~ursuant <br />to the judicial decree of the Honorable William M. Calvert, District <br />Judge dated on March 12, 1974. The litigation in the District Court <br />Civil Action No. 74660 was entitled: Castle Concrete Comps.n a <br />Colorado Corporation,, Plaintiff, vs. Harold In raham, The Eoard of <br />Commissioners of the County of E1 Paso, State of Colorado, The E1 <br />Paso County Planning Commission, and Perry Tyree, Executive Director of <br />The Regional Building Department of the County of E1 Paso, Colorado, <br />~~ Defendants. <br />This order provided in part: <br />A zoning resolution must be interpreted in a reasonable <br />manner. <br />Castle owns eighty acres in one mining location; that <br />ground across in William's Canyon is a separate tract and <br />should that area be mined, a permit would be required. <br />I conclude that there was a vested right to mine the <br />land at the time the quarry was established. <br />Accordingly, I hold that the proper interpretatio.~ of <br />the zoning resolution requires no permit for the ~=_ighty <br />acre tract wherein the present quarrying operatio:ls are <br />taking place and have taken place since before Ca:atle <br />acquired the land. <br />WHEREFORE, IT IS ORDERED that Castle Concrete Com~~any may <br />operate its quarry in the E 1/2 of NW 1/4 Section 32, <br />Range 67 West of 6PM in Township 13 South without permit <br />or approval of location by the E1 Paso County Pla~ining <br />Commission. <br />~~ Done in chambers this 12th day of March, 1974. <br />William M.
