CASTLE CONCRETE COMPANY'S
APPLICATION
SNYDER QUARRY
77-210
LOCAL GOVERNMENT APPROVAL

Castle Concrete Company has a legally adjudicates. right to
mine within its 80 acre mining tract at the Snyder Quarry F~ursuant
to the judicial decree of the Honorable William M. Calvert, District
Judge dated on March 12, 1974. The litigation in the District Court
Civil Action No. 74660 was entitled: Castle Concrete Comps.n a
Colorado Corporation,, Plaintiff, vs. Harold In raham, The Eoard of
Commissioners of the County of E1 Paso, State of Colorado, The E1
Paso County Planning Commission, and Perry Tyree, Executive Director of
The Regional Building Department of the County of E1 Paso, Colorado,
~~ Defendants.
This order provided in part:
A zoning resolution must be interpreted in a reasonable
manner.
Castle owns eighty acres in one mining location; that
ground across in William's Canyon is a separate tract and
should that area be mined, a permit would be required.
I conclude that there was a vested right to mine the
land at the time the quarry was established.
Accordingly, I hold that the proper interpretatio.~ of
the zoning resolution requires no permit for the ~=_ighty
acre tract wherein the present quarrying operatio:ls are
taking place and have taken place since before Ca:atle
acquired the land.
WHEREFORE, IT IS ORDERED that Castle Concrete Com~~any may
operate its quarry in the E 1/2 of NW 1/4 Section 32,
Range 67 West of 6PM in Township 13 South without permit
or approval of location by the E1 Paso County Pla~ining
Commission.
~~ Done in chambers this 12th day of March, 1974.
William M. Calvert, District Judge
/. S-N-2 ~
