<br />• C. Subsequently, the Lease was assigned from Ember to
<br />Consolidation Coal Company ("Consol"),. whose address is 1800
<br />Washington Road, Pittsburgh, Pennsylvania 15241, pursuant to an
<br />Assignment dated October 29, 1975, which assignment was recorded
<br />in the records of the Moffat County Clerk and Recorder on
<br />February 10, 1976, in Hook 408 at Page 962 and also in the
<br />records of the Rio Blanco County Clerk and Recorder on December
<br />23, 1975, in Book 353 at Page 259.
<br />D. The Lease was thereafter assigned by Consol to
<br />Reserve Coal Properties Company by as Assignment dated September
<br />1, 1989, which was recorded in the records of the Moffat County
<br />Clerk and Recorder on October 4, 1989, in Book hoe at Page 797,
<br />and also recorded in the records of the Clerk and Recorder of Rio
<br />Blanco County on October 4, 1989, in Book 479 at Page 884.
<br />E. The Lease contained extension provisions and in
<br />1990 a second ten-year extension of the Lease was obtained to
<br />extend the Lease in full force and effect until September 19,
<br />2000. An Affidavit of Lease Extension, dated November 12, 1990,
<br />was filed in compliance with the provisions of Section 38-42-106,
<br />C.R.S. 1973, in the Clerk and Recorder's office of Moffat County
<br />on December 10, 1990, in Book 626 at Page 132,
<br />F. Pursuant to a deed dated April 30, 1981, one of
<br />the original lessors of the Lease, Dorothy Card James Polk,
<br />• formerly known as Dorothy Card James, conveyed varying interests,
<br />including undivided interests, in all of her coal, oil, gas and
<br />other minerals in, on and under certain parcels of real property
<br />including property subject to Che Lease and the Assigned Portions
<br />of the Lease, to Guy T. shefstead and Holmes H. Shefstead, whose
<br />address is 595 Barclay, P.O. Box 608, Craig, Colorado 81625.
<br />This deed was recorded fn the records of tha Moffat County Clerk
<br />and Recorder on May 4, 1981, in Book 490 at Page 124 and was to
<br />correct that certain Warranty Deed dated January 7, 1981 as ,
<br />recorded in the records of the Moffat County Clerk and Recorder
<br />on January 19, 1991 in Book 484 at Page 607.
<br />G. Assignor desires to grant, assign and convey to
<br />Assignee all of Assignor's right, title, and interest in the
<br />Assigned Portion of the Lease. Assignee desires to accept the
<br />assignment of the Assigned Portion of the Lease and the parties
<br />agree as follows:
<br />NOW, THEREFORE, in consideration of the amount of Ten
<br />Dollars ($10.00) and other good and valuable consideration, the
<br />receipt and sufficiency of which are hereby acknowledged, the
<br />Assignor hereby grants and assigns to Assignee, its successors
<br />and assigns, all of Assignor's right, title and interest in and
<br />to the Assigned Portion of the Lease as follows:
