Atkinson, Vice President <br />Land & Environmental Affairs <br />Colowyo Coal Company <br />5731 State Highwa;r 13 <br />Meeker, CO 81641 <br />Dear Mr. Atkinson: <br />In response to your letter of November 25, 1991, I would like <br />to confirm Rio Blanco County's requirements with reference to <br />Colowyo Coal Company's operation adjacent to the Rio Blanco County <br />line. In your letter you indicated that Colowyo is in the process <br />of revising its mining and Reclamation Permit to include mining of <br />coal in Sections 15 and 16, T3N, R93W, which borders the Rio Blanco <br />County line. In addition, Colowyo plans to construct a sediment <br />control ditch approximately 1/4 mile long and a boundary fence <br />approximately 1 mile long that will be just south of the mining <br />operation within Rio Blanco County. <br />(• <br />Rio Blanco County does not presently require a permit to <br />construct a sediment control facility or a fence. As a result, the <br />above sediment control facility and Pence will not require a permit <br />from Rio Blanco County. Please be advised, however, that mining <br />operations are required to obtain a Special Use Permit from Rio <br />Blanco County. If in the future the actual mining operation <br />(excavation) enters Rio Blanco County, a Special Use Permit will be <br />required.
