Dear Mr. Atkinson:
In response to your letter of November 25, 1991, I would like
to confirm Rio Blanco County's requirements with reference to
Colowyo Coal Company's operation adjacent to the Rio Blanco County
line. In your letter you indicated that Colowyo is in the process
of revising its mining and Reclamation Permit to include mining of
coal in Sections 15 and 16, T3N, R93W, which borders the Rio Blanco
County line. In addition, Colowyo plans to construct a sediment
control ditch approximately 1/4 mile long and a boundary fence
approximately 1 mile long that will be just south of the mining
operation within Rio Blanco County.

Rio Blanco County does not presently require a permit to
construct a sediment control facility or a fence. As a result, the
above sediment control facility and Pence will not require a permit
from Rio Blanco County. Please be advised, however, that mining
operations are required to obtain a Special Use Permit from Rio
Blanco County. If in the future the actual mining operation
(excavation) enters Rio Blanco County, a Special Use Permit will be
required. For your information I have enclosed an information
sheet on Special Use Permits.
