r~ <br />` C -3587*~ <br />i <br />PARTIAL ASSIGNMENT OF FEDERAL COAL LEASE <br />TNIS PARTIAL ASSIGNMENT, is made this ~ day ofd Sir 1982, by <br />Conso li datlon Coal Company ("Aselg nor"), whose address is Consol Plaza, <br />Pittsburgh, PA 15241, to Colowyo Coal Company ("Assignee"), whose address <br />Ss 5731 State Highway 13, Meeker, CO 81641. <br />RECITALS <br />A. Assignor was the successful bidder for a federal coal lease <br />from the United States Department of the intertoc ("Inter for"), on [he <br />Danforth Hi118 it Tract C-29224 (the "DH /1 Lease"), and OH 41 Lease has <br />been fssued by Interior to Assignor effective July 1, 1981 (Lease No. <br />C-292241. <br />B. Assignee is currently conducting surface mining operations <br />on its surface lands adjolni ng Lease No. C-29224 in Section 2, T3N, A97W, <br />end Ste pit is presently just north of the north boundary of Lease No. C- <br />29224. <br />C. Assignor and Assignee recognize that there is a limited ' <br />' • amount Of surface recoverable coal in the northwest corner of Section 11, <br />T3N, R93W, which Could be recovered by Asslg nee Sn the course of the <br />logical progression of its pit advance, and that such coal, if not <br />recovered by Ass lg nee, will not be recovered by Assignor, and will be <br />"wasted". <br />D. The coal in Sec tlon 11, T3N, R93W, is federal coal leased by <br />Interio[ to Ass ig no[ ands[ Lease No. C-29224. The surface of Section 11 is <br />owned by Assignee and portions of Assignee's privately owned surface are <br />included in Assignee's approved mine plan for its Colowyo Mine and is being <br />used by Asslg nee for haul roads, utility power lines, surface run-off <br />control, spoil disposal, tap soil storage, and other mine cela red uses, as <br />shown on the map attached hereto and made a part hereof. <br />E. In the interest of coal resource recovery and coal <br />conservation, Assignor desires not to have the surface recoverable coal Sn <br />the northwest corner of Section 11 "wasted" and Ass ig no[ is therefore <br />willing to make it possible for each coal to be recovered by <br />• <br />C~nloe.r~o Cr <br />
