Olson, President <br />5731 State Highway 13 <br />Meeker, CO 81641 <br />Consent of Surety and New Bond Accepted <br />Partial Assignment Approved <br />'`'~ Cr ~. ~i. pls N <br />On April 23, 1982, Colowyo Coal Company filed a request for approval of <br />a partial assignment of coal lease C-29224 from Consolidation Coal <br />Company. <br />The lease account is in good standing. The assignee has met all of the <br />requiranents of 43 CFR 3453, including the submission of information for <br />Attorney General review under the antitrust laws and the consideration <br />paid for the transfer. An acceptable consent of surety to the transfer <br />and its agreement to remain bound as to the interest retained by the <br />assignor was filed July 8, 1982. An acceptable $125,000 surety bond <br />with Colowyo Coal Company as principal and The Travelers Indemnity <br />Company as surety (P. J. Fanner, Attorney-in-Fact, The Talbert Corporation, <br />P. 0. Box 9364, Denver, CO 80209) was filed June 25, 1982. <br />By memorandum dated June 8, 1982, the Minerals Management Service reported <br />that the strippable coal in the new lease will be mined by Colowyo Coal <br />Company along with the exploitation of Coal Lease D-034365, consequently, <br />the new lease becomes a part of a logical mining unit. The area remaining <br />in Coal Lease C-29224 is also a logical mining unit. <br />The assignee has requested, in writing, that the transfer be effective <br />the first day of the month of the approval as provided in regulation 43 <br />CFR 3453.3-3. , <br />Therefore, the partial assignment is approved as of July 1, 1982. The <br />new lease will contain the same terms and conditions as the original <br />lease pursuant to regulation 43 CFR 3453.2-6, not withstanding any terms <br />in the assignment to the contrary.
