Ms. Katy Soto
RE: July 15, 2005 Letter to Black Hawk-Central City Sanitation District:
Structure Agreement for Proposed Mining Operation, Clear Creek District
Water Providers, LLC, MMRR Quarry; Gilpin County, CO
August 4, 2005
Page 2
a Any traffic studies and plans for traffic on Highway 119 including the size, type
and loaded weight of hauling equipment and its anticipated frequency of use on the highway.
You should be aware that the consequences of damage to the treatment plant could be
severe considering the potential for water quality degradation in North Cleaz Creek and
downstream water supplies. For these reasons we do not believe an indemnity of the District
against damage is sufficient. Additional assurance would be necessazy before the District could
withdraw its objection to your application.
Please contact me if you wish to further discuss this matter. I would appreciate your
response to our concerns as soon as possible.
Sincerely,
SETER & VANDER WALL, P.C.
~~. ~~
Kim J.
