(d) Each application shall contain a statement of any current or • previous coal mining permits in the United States held by the applicant subsequent to 1970 and by any person identified in Paragraph (b) (3) of this Section and of any pending permit application to conduct surface coal mining and reclamation operations in the United Sates. The information shall be listed by permit or application number and identify the regulatory authority for each of those coal mining operations. The coal mining permits currently or previously held by the applicant, Kerrco, Ltd., and EFC Resources, Ltd. subsequent to 1970 are listed as follows: (1) 1973 Colorado Open Mining Land Reclamation Act - Permit No. 74- 53 Approved September 16, 1974 by the Colorado Mined Land Reclamation Board. (2) 1976 Colorado Mined Land Reclamation Act - Permit No. 76-13: Issued September 3, 1976 by the Colorado Mined Land Reclamation Board and subsequently amended on 3/22/77, 9/23/77, 12/15/77, and 4/25/80. (3) 1980 Colorado Mined Land Reclamation Act - Permit No. C-80-006: Issued March 20, 1981 by the Colorado Mined Land Reclamation Board and subsequently renewed on July 10, 1986, March 20, 1991, and March 20, 1996 and March 20, 2001 by the same. Permit • renewal application filed September 20, 2005, approvals pending. (4) 1977 Surface Mining Control and Reclamation Act - Permit No. CO- 0002: Issued March, 1981 by the Office of Surface Mining and subsequently renewed on November 6, 1986 by the same. In addition to this permit {C-80-006) for the Kerr Mine, Kerr Coal, the applicant, its general partner, sole shareholder, and officers and directors (identified above) have also operated and held surface coal mining permits for the following coal mining operations in the United States within the five (5) years preceding the date of this application revision. • 778-5R Revised - February 2006 RN-O5
