<br />ISIS PER`lIT is issued this 11th day of Sept. 1980 by the `fined Land
<br />Reclamation Board, Department of D'atural Resources, Sta*_e of Colorado.
<br />w I T `: E S S E T H
<br />SdHEREaS, BACA COUNTY desires to conduct a(n) open miring
<br />operation, known as Gravel Pit No. 2 for the puroose or extracting
<br />mined sand and gravel.
<br />:v~?ERE~1S, on October 13 19 77, BACA COUNTY "FILE" an
<br />annlication,a reclamation plan and map, and the required fee, as required by la::; and
<br />'.vY.ERE?.S, on July 23 19$0 the ?Lined Land Reclamation Board approved
<br />application and set bona; and
<br />i;::ERE_~S, on September 11> 19$0 the ,fined Land Reclamation Board accepted
<br />surety submitted by - BACA COUNTY and such date shall be considered tie
<br />date of issuance of the permit and the anniversary date for all other purposes; and
<br />,• ?.1~ERL=.S, the :4ined Land Reclamation Board has made a finding, fcr the purpcses
<br />of issuing this permit, that:
<br />1) the applicatior, complies with the reeuirements of the Colorado
<br />`!iced Land Reclamation .~.ct and all applicable local, state and
<br />Feceral laws; and,
<br />• ?) the operation will not adversely affect the stability of any
<br />significant, valuable, and permanent can-made structures located
<br />within two hundred feet of the affected land, except where [here
<br />is an agreement becaeen the operator and the persons having an
<br />interest in th=_ structure that damage to the structure is [o be
<br />compensated for by the operator; and,
<br />3) the proposed mining operations and reclamation can be carried out
<br /> in conformance with the requirements of C.R.S. 1913, 34-32-116, as
<br />- • amended (1916 Sess. Laws H.B. 1065); and
<br /> W?:EREnS, for the purposes of issuing this permit, *_he op erator has :ado a
<br /> satisfactory showing to the Board that he will employ during and after his
<br /> open mining operations procedures reasonably designed to minimize
<br /> as much as practicable the disruption from the open mining operations
<br /> ar.d will provide for the rehabilitation of the affected lard LhrOLEh the rehabilita*_icn
<br /> of plant cover, soil stability, water resources, and other me asures appropriate to t::^.e
<br />• subseeuent bene_'icial use of such mined and reclaimed lands; and the*_ in the event
