Nolan, MD, MPH <br />Exm4he Din+tlor <br />The Division has reviewed your letter of January 4, 1993 regarding the past circumstances and <br />current status of your involvement in Trinidad Basin. It is the Division's opinion that you are <br />responsible for the discharges from the sediment ponds which were constructed as part of a past <br />mining activity on the site. Federal regulations state that a discharge permit is necessary for this <br />type of activity until such time that the bond is released. <br />The weather and access problems that you mentioned do not relieve you from the responsibility of <br />complying with federal and state regulations. These issues can, however, be considered when the <br />Division determines a civil penalty appropriate to resolve the Notice of Violation. <br />The Division would be happy to meet with you to discuss this matter.
