Whether the District Curt improperly affirmed the issuance of a <br />reclamation permit in file M-2004-067 despite the fact that the applicant did <br />not provide an adequate estimate of reclamation costs or an adequate <br />reclamation bond, as are required by C.R.S. § 34-32.5-117 and C.M.R. 4.2.1 <br />and 6.4.12. <br />F. Whether the District Court erred as a matter of law in finding that the <br />MLRB's factual findings need merely be supported by some rational <br />evidence rather than by substantial evidence, as is required by C.R.S. § 24-4- <br />106(7). <br />G. Whether the District Court improperly affirmed the issuance of a <br />reclamation permit in file M-2004-067 despite the MLRB's failure to <br />explore the permit's potential impacts on waters of the United States. <br />III. TRANSCRIPTS <br />No hearings were held before the District Court, and, therefore, no <br />transcripts are necessary for any District Court proceedings. However, a transcript <br />of the hearing held before the Mined Land Reclamation Board on December 14, <br />2005, may be necessary to resolve the issues raised on appeal. Such transcript has <br />already been produced as part of the vast administrative record that consists of <br />3,278 pages plus an index in this case. <br />IV.
