39. Issue 7(M), Adequacy of Estimate of Reclamation Cost Required [o Complete <br />Reclamation Plan and Achieve Post .Mining Land Use (Rule 6.4.12 -Exhibit L). As <br />stated in the Division's Rationale, the Applicant has provided an adequate estimate of the <br />reclamatlon cost required to reclaim 34.28 acres of affected lands to wildlife habitat. The <br />Applicant has provided itemized costs ibr seedbed prepazation, revegetation with a grass <br />mix, and reestablishment of shrubs and trees via shrub and tree transplants. The Division <br />has determined that these estimated costs are reasonable and adequate to reclaim the <br />affected lands as wildlife habitat. As the Division noted, the amount of the reclamation <br />bond can be adjusted at any time ifthe Division or Board determines an adjustment is <br />necessary pursuant to Rule 4.2.1(2). <br />40. The weight of the evidence demonstrates that the Applicant has met the minimum <br />requirements of Rule 6.4.12 -Exhibit L. <br />41. Issue 7(N), Statement Identifying Permits, Licenses and Approvals Necessary to <br />Conduct Proposed Mining Operations (Bute 6.4.13 -Exhibit M). Rule G.4. E3 <br />requires an applicant to provide a statement identifying which pemtits, licenses and <br />approvals it holds or will be seeking. In response to specific objections raised by party <br />objectors, the Division concluded in its Rationale that the Applicant had satisfied the <br />requirements of Rule 6.4.13 by appropriately listing those permits and approvals which <br />the Applicant held or would be seeking. Notably, the Applicant entered into a stipulation <br />with Gilpin County prior to the Boazd hearing which obligates the Applicant to seek all <br />necessary permits and approvals from Gilpin County. In response to a specific objections <br />raised by party objeclors, the Applicant has demonstrated an approved highway access <br />permit as issued by CDOT on August 23, 2005 and has also committed to obtaining <br />MMRR Board Older, M-2004-067 l7 <br />2687 <br />
