§2.03 APPLICATION FOR PERMIT FOR SURFACE OR UNDERGROUND MINING <br />ACTIVITIES -MINIMUM REQUIREMENTS FOR LEGAL, F{NANCIAL, COMPLIANCE, <br />AND RELATED INFORMATION. <br />2.03.7 Relationship to Areas Designated Unsuitable for Mining. <br />(1) The permit area is not within an area designated unsuitable for surface <br />mining activities as defined in Rule 7 or 30 CFR 764 and 765, or under <br />study for designation in an administrative proceeding under Rule 7 or <br />30 CFR 764 and 765. <br />(2) No response required. Not applicable. <br />(3) The applicant or its predecessor has been operating the surface <br />facilities since 1976 and there are no changes in location of these <br />facilities proposed by this permit revision. Therefore, no waiver is <br />required. <br />2.03.8 Permit Term Information. <br />(1) Surface mining activities (open pit or strip mining) are not planned <br />within the permit area. <br />(2) The facilities within this permit boundary extension have been <br />operating since 1976, are currently operating at the rate of 1 million <br />tons per year and are expected to continue operating at this rate <br />through the permit term of the current Bowie No. 2 Mine. <br />(3) The applicant requests that all information, operational plans, and <br />reclamation plans included in this volume are made part of the Bowie <br />No. 1 mine permit and run concurrently with that permit term. <br />2.03.9 Personal Injury and Property Damage Insurance Information. <br />Refer to Volume I -Text, Section 2.03.9 for this information.
