<br />TN Di GRAVEL LEASE CONTRACT, hereinafter referred to as Contract, is

<br />the County of Montezuma, Colorado by the Board of County Commissioners of Montezuma
<br />County, Colorado, hereinafter referred to as First Party, and Elanor Tozer, of the
<br />County of Montezuma, State of Colorado, hereinafter referred to as Second Tarty.

<br />NHEREAS, Second Party is oxner of the SE w N41 a in Seotion 36, Toxnehip
<br />36 North, Range lA West, N,M,P,M „ Montezuma County, Colorado, xhich land has
<br />thereon, in and under same gravel, sand and other materials suitable for road,
<br />air;,ort and bridge construction,
<br />AND KHEREAS, Second Party is desirous of selling said gravel, eaad and
<br />materials,
<br />AND 6fH~tF.AS, First Party is desirous of obtaining gravel, Band and
<br />material for purposes of road, airport and bridge construction,
<br />N(iW TH~J7EFORE, in consideration of the preniees and of the payments as
<br />hereinafter set forth by First Party to Second Party, Second Party hereby grant,
<br />let and give unto First Party a levee upon the hereinafter described lands for the
<br />purposes of mining and removing Band, Brawl and materials therefrom suitable for
<br />road, airport and bridge construction upon the hereinafter set forth terms,
<br />covenants and conditions, sad First Party hereby accepts said lease upon said terms,

<br />PF~EiIOD OF LRASF,~ The period of -this lease shall be from 1200 o'clock
<br />noon on the 1st day of January, 1975 to 1200 o'clock noon on the let day of

<br />Nest, *',M,P,M „ Montezuma County, Colorado for the purpose of mining and removing
<br />sand, gravel and other materials used in or in connection xlth constuuction and
<br />maintenance of roads, airports sad bridges,
<br />RPNTAL - ROYALTY First Party shall pay to Second Party the sum of
<br />$0,15 per cubic yard of Band, gravel and materials mined and removed,ik'om said
<br />premises by First Party, and First Party guarantees to Second Party a minLnim
<br />royalty of $100,00 per year for each year of this Contract, said $100.00 tc be
<br />paid thusly $100,00 upon exeoution of this Contract and $100.00 within 30 days
<br />of anniversary date each year hereafter for the period of this lease, and the
<br />first $100,00 xorth of sand, Brawl and'eeteriale mined sad removed from said
<br />properties each year shall._be.epplleQ aga3+rt 9:ald $100.00 eo paid and the
<br />balance of any royalties due shall be paid to Second Party on ar before 90 days
<br />after the same has been mined end removed 11t~ said properties.
<br />COVE?JANTS OF FIRST PARTY First Party shall mine and remove said
<br />gravel, sand and material in a manner not to interfere with the surface of said
<br />lands so long as it does not reasonably Interfere xith esid mining and removal
<br />operations, and upon termination of this Contract First Party shell level oiY aepr
<br />monde of dirt and other materials piled by it in its mining and removal operation.
