• 2.03.5 Compliance Information <br />(1) Neither the applicant, any subsidiary, affiliate nor person <br />controlled by or under common control with the applicant has: <br />(1) (a) nad a tederal or state mining permit for surface coal mining <br />operations suspended or revoked within five (5) years prior to the date of the <br />submission of this application; or <br />(1) (b) forfeited a mining bond or similar security deposited in lieu of <br />bond. <br />(2) Not applicable. <br />(3) (a)-(~) During the past three years, the applicant iias received the <br />following violation notices in connection with the operation of its permit no. <br />C-81-039, which is the applicants only surface mining operation in Colorado: <br />ll) Colorado Mined Land Reclamation Division (MLRD) Notice of Violation <br />(NOV) C-86-O1U issued February 2, 1986. This NOV was for failure to provide <br />adequate reclamation bond coverage. Bond was provided and civil penalty <br />assessed was S0. <br />• (2) MLRD NOV C-86-U65 issued September 9, 1987, was for tailure to <br />maintain sediment control structures to prevent additional contributions of <br />sediment to streamflow outside the permit area, minimize erosion, and minimize <br />disturbance to the prevailing hydrologic balance. Sediment control structures <br />were cleaned/maintained and civil penalty assessed was S0. <br />(3) MLRD NOV C-87-031 issued August 11, 1987, was for tailure to main- <br />tain culverts. Culverts have been maintained and civil penalty is pending. <br />(4) MLRD NOV C-87-038 issued August 11, 1987, was for tailure to <br />maintain records at the mine area. Records have been sent to mine area for <br />inspection and civil penalty is pending. <br />(5) MLRD NOV C-81-039 issued August 18, 1981, was for tailure to divert <br />runoff through a defined ditch to the sediment pond at Pit 4. Runoff is now <br />directed to Pond 4. Civil penalty is pending. <br />u <br />I-4 <br />12/87 <br />
