(A gravel pit, under Colorado <br />law, is deemed a well.) Pursuant to that section, the holders of well permits within 600 feet are <br />required to file a Statement of Opposition to the Water Court proceeding ifthey believe the proposed <br />grave] pit operation might cause injury to their water rights. <br />On February 28, 2006, we filed, on behalf of Lafarge West, Inc. a Water Court application <br />as Case No. 06CW20. (North Bank Iioldiags, Inc. is a Co-Applicant is this case as the owner of the <br />North Bank property.) The purpose ofthe'VVater Court application is to obtain a legs] water supply <br />forthe gravel pit operation and subsequent reclamation of the site. Pursuant to Colorado law, anyone <br />wishing to oppose the case or arryonc who is concerned that their water rights may be injured by the <br />proposed operation was zequired to file a Statement of Opposition by Apri130, 2006. Please be <br />aware that no one filed a Statement of Opposidon to the Application, <br />The augsxientation water for the gavel pit operation and subsequent reclamation is water <br />stored in various reservoirs .
