i

issued, all existing site conditions which differ from those in your permit must be made to
conform to those specified in your permit (such as all slopes being 3:1 during mining, topsoil piles
being seeded, etc.), and 4) that no other activity is to occur in the present 111 permit that is not in
conformance with .the provisions of that permit, nor which act to disturb the site in excess of the
present bond amount ofthat permit.
After your permit is issued, Mr. Popejoy will be released from all further reclamation
responsibility for his permit, and you will be the party responsible for operating and maintaining
the site according to the new permit, which includes selling and exporting material.
I have covered a lot of ground in this letter, partly because of the timeframe we are trying to
compress, and because I want all the different parties involved to understand how this final part of
the process must all fit together. 'As you can see, some of the responsibility for timely action lies
outside of this office. We will try to coordinate the process quickly as I described above; so that
the permit can be issued as soon as possible, but I cannot promise that it can be done while I am
absent. Please be reminded that the decision date is presently set for 7/30/98. If you have
questions, please feel free to contact me at the address or phone below, or contact Ms. Barbara
Chiappone at our Denver office (see letterhead).
Division of Minerals and Geology
484 Turner Dr., Bldg.
