M.D.
Executive Director
CERTIFIED NAIL N0: 149 902 270
We have recently received information from the Colorado Mined Land Reclamation
Division (Ct4.RD) which may affect your Colorado Discharge Permit System (CDPS)
permit. This concerns discharges from spoils springs. CMLRD has identified
the following area(s) at your site as being sources of spoils spring water:
A spoils spring discharging to
Pond No. 5
Any such discharges may be considered as point sources or contribute to a
point source discharge and are therefore subject to CDPS Regulations. Your
permit does not currently authorize such discharges.
If such discharges do in fact eziat, you should immediately write our division
to request a perait amendment. Your request should include the number of
spoils spring sources, any treatment provided, volume of water generated from
these sources, results of any analyses of such spoils eater, the date
discharges began, receiving waters sad any other related information. A Bite
sketch should be included, which show at a minimum, the location of each
discharge, flow path to the eedimeatation pond, if applicable and the
receiving ester. If spoils ester flow into a sedimentation pond, please
elate in your narrative whether the pond ie sized to handle this water in
addition to surface runoff and whether the CMLRD has approved of routing this
ester through the pond.
Please note that even if the spoils ester flows into a pond which has an
authorized discharge point, your permit does not now authorize discharge of
this source. The permit wa written to address surface runoff discharge• only
from this point. Tha spoils spring discharge ie considered to ba a change in
discharge sub~eet to Part II.A.1. of your permit.
O •C
0~
DEPARTMENT
~ 18T6 rt

K ~V~~
OF HEALTH
4210 EAST 11TH AVENUE DENVER, COLORADO 80220 PHONE (303) 320-8333
