Shelton <br />Director <br />t4arch 15, 1983 <br />Mr. Robert Humphrey <br />Baca County Land Use <br />Baca County <br />741 Main Street <br />Springfield, Colorado <br />Administrator <br />81073 <br />Re: Colorado Division of Highways' "McVey Pit" - 111 Permit Transfer <br />File No. 78-2.25A <br />Dear Pir, Humphrey: <br />This letter is in response to your request for Baca County to succeed the <br />Colorado Division of Highways as the operator of the above captioned operation. <br />I am sorry that this response to your request did not occur sooner; but our <br />staff needed time for consultation on the question of the appropriateness of a <br />succession of operators on a 111 permit. <br />As you may be aware, a 111 permit is a "fast-track," 10-day process time permit <br />based on a government contract requiring delivery of sand and oravel within a <br />specified short period of time. After the contract is completed, the pit is to <br />be reclaimed. Thus a 111 permit cannot be succeeded to in the manner of a <br />110 or 112 permit. <br />What Baca County should do is to request that they receive a 110 permit for <br />this site, using the application materials submitted by the Division of Highways <br />as the required exhibits. Since you have already supplied a new application <br />form, new source of legal right to enter (Exhibit G), and a permformance <br />warranty, as suon as the formal request to have a 110 application for this <br />site considered by the Board is received it will be considered as a complete <br />110 application. Baca County will have to publish twice in a local newspaper <br />and notify all immediately adjacent landowners (The complete letter will have <br />the publication format on the back.) <br />The performance warranty is adequate, with one exception. The legal description <br />was omitted. I have added this description to page 4 of this warranty as "Exhibit <br />A" as follows: "Part of the NW'; SW„ Sec. 9, T31S, R50W of the 6th P.14.". <br />
