3. Noncompliance Notification
a) If, for nay reason, the permittee does not comply with or will
be unable to comply with any discharge limitations ar s•tandards
specified in this parmit, the permittee shall, at a min:imuco,
provide the Water Quality Control Division and EPA with the
following information:
(1) A description of the discharge and cause of noncomp:iance;
(11) The period of noncompliance, including enact dates and
times and/or the anticipated time when the discharge will
return to compliance; and
(111) Steps being taken to reduce, eliminate, and prevent
recurrence of the noncomplying discharge.
b) The permittee shall report the following instances of
nancompliaaca orally within twenty-four (24) hours froo: the time
the permittee becomes aware of the noncompliance, and aha11 mail
to the Division a written report within five C5) days a-fte:r
becoming aware of the noncompliance:
(1) Aay instance of noncompliance which may endaage:r heealth
or the environment;
(11) Any unanticipated bypaea;
(iii) Aay upset which causes an ezeeedance of any effluent
limitation in the permit;
(iv) Any spill which causes nay effluent limitation to be
violated;
(v) Daily mazimum violations for any.tozic pollutao.ts or
hazardous substances limited by PART I-A of this permit
and specified as requiring 24 hour notification.
c) The permittee shall report all other instances of non•-compliance
not requiring 14-hour notification at the time Discharge
Nopitoriag Reports are submitted. The reports shall contain the
information listed is sub-paragraph•(a) of this section.
