Part I <br />PaF;e li of 19 <br />Permit No. CO-00321:15 <br />B. MONITORING REQUIREMENTS <br />8. Preliminary Toxicity Investigation (Cont.) <br />If the preliminary toxicity investigation identifies a probable <br />toxicant and/or a probable source of tonicity, the permittee shall <br />submit, as part of its final report results, written notification to <br />that effect to the Diviaioa. Within 30 days of completing the <br />preliminary toxicity investigation, the permittee shall submit for the <br />Division's approval a control program to control effluent tozi.city, <br />and shall proceed to implement such plan within 7 days following <br />approval by the Division. <br />If ao probable explanation for toxicity is identified in the :LS-day <br />preliminary toxicity investigation, a Phase I Toxicity Reduct:Lon <br />Evaluation (TRE) is required. The permittee shall notify the <br />Division, as part of its final report, of its intent to proceed with <br />the Phase I TRE. <br />If toxicity disappears during the preliminary toxicity investigation, <br />the permittee shall submit written notification to that effect to the <br />Division. The Division may require the permittee to conduct <br />accelerated testing to demonstrate the continued absence of toxicity. <br />If no acute toxicity is found to exist, the toxicity incident: is <br />closed. <br />9. Phase I THE <br />The Phase I THE performed by the permittee shall be in gener:~l <br />accordance with Methods for Aquatic Toxicity Identification <br />Evaluations, Phase I, Toxicity Characterization Procedures (September, <br />1 pu is e y EPA, or in actor ante wi procedures approved by <br />the Division. If only one species demonstrated toxicity during <br />accelerated testing, then that species alone may be used in the Phase <br />I TRE. The permittee has 45 days from the submission of the final <br />report on the preliminary toxicity investigation to complete the Phase <br />I THE and submit a report to the Division on the results of the study. <br />If the Phase I THE identifies a probable toxicant and/or a probable <br />source of tonicity, the permittee shall submit written notification to <br />that effect to the Division as part of the report. Within .LO days of <br />completing the Phase I TRE, the permittee shall submit for t:he <br />Division's approval a control program to control WET, and shall. <br />proceed to implement such plan within 7 days following approval by the <br />Division. <br />If the Phase I THE fails to identify a probable toxicant an~i/or a <br />probable source of toxicity, the permittee shall notify the Division <br />of its findings. The Division will determine whether a Phase :II THE <br />is applicable. <br />
