Please find enclosed a copy of correspondence received from the Colorado
Division of Wildlife (DOw) regarding the above referenced application.
DOW's primary concern is with mining of the riparian area at the
northwest corner of the property. Other key concerns expressed are with
the frequency of tree and shrub planting proposed and with the inclusion
of Russian Olive plantings in the reclamation plan.
The proposed reclamation plan for the west side of the property calls
for creation of wildlife habitat. You are referred to Rule 3.1.8(2) of
the Mineral Rules and Regulations which states:
Habitat management and creation, if part of the Reclamation Plan,
shall be directed toward encouraging the diversity of both game
and non-game species, and shall provide protection, rehabilitation
or improvement of wildlife habitat. Operators are encouraged to
contact the Colorado Division of Wildlife and/or federal agencies
with wildlife responsibilities to see if any unique opportunities
are available to enhance and/or benefit wildlife which could be
accomplished within the framework of the Reclamation Plan and
costs.
Please address the concerns raised by DOW in your response to the
Division's adequacy letter. The areas in question can be inspected, and
the issues further discussed, during the Division's up-coming pre-
operational inspection of the site.
