Lochhead <br />&ecmive Duecior <br />Re: Costilla County's Sierra Grande Site, File No. M-94-103, Receipt of Lim3~t~d~IBL^^s <br />Impact Operation (110) Reclamation Permit Application Division D~rermr <br />Dear Mr. Devereaux: <br />On June 21, 1995, the Division of Minerals and Geology received your 110(2) <br />application package for Costilla County's Sierra Grande Site, File No. M-94-103. <br />Preliminary review determined that the following items must be submitted before <br />the application can be considered submitted and technical review can begin: <br />EXHIBIT G - Source of Legal Rioht-to-Enter (Rule 6.3.7): The statement <br />submitted stating that Costilla County has the right-to-enter the property <br />and mine must be signed and notarized. <br />An affidavit or receipt indicating the date on which the <br />ion was placed with the local County Clerk and Recorder. <br />Conservation District (Rule 6.3.10): Proof of actual de2'ivery~or proof of <br />mailing by Certified Mail, return receipt requested; of Notice of the <br />Application to the local Board of County Commissioners and, if the mining <br />operation is within the boundaries of a Soil Co>servation District, to the <br />Hoard of Supervisors of the Soil Conservation District. Forms are enclosed <br />in the permit application. <br />Rule 1.6.2(1)(b) (Effective May 1, 1995): You must post notices at the <br />location of the proposed mine site, of sufficient size and number to <br />clearly identify the site as the location of a proposed mining operation <br />giving your name, address, and phone number, and stating that you have <br />applied for a mining permit with the Colorado Mined Land Reclamation Board. <br />Your notice must also state that anyone wishing to comment on the <br />application may view the application at the Fil.amoea County Clerk and <br />Recorder's Office and should send comments prior to the end of the public <br />comment period to the Colorado Mined Land Reclamation Division, Room 215, <br />1313 Sherman St, Denver, Colorado 80203. <br />After posting this notice you must provide a signed affidavit that such <br />notice has been posted according to the provisions of this Rule and submit <br />the off idavit to the Division. <br />You may amend the application by submitting all of the requested items. In <br />accordance with Rule 1.8, a new decision date will be established 30 days from <br />the date of receipt of all requested items. If you have already initiated <br />publication, you will need to republish notice which specifies the final date for <br />receiving comments is ten (10) days after the date of publication or the next <br />regular business day. <br />
