Simpson, P.E. <br /> Slate Engineer <br />RE: Challenger Pit Substitute Water Supply Plan, DMG File No. M-85-026 <br />Section 29, T 5 N, R 67 W, 6"' P.M. <br />Water Division 1, Water District 4, Weld County <br />Dear Mr. Weiland: <br />I apologize for the great delay in reviewing and processing this application for a substitute supply <br />plan for the Challenger Pit. I have reviewed a proposed plan that was prepared by our outside consultant, <br />and need to request the following additional information: <br />1) A portion of the required replacement water is to be provided by a lease with the City of Loveland. <br />Please provide a copy of the current lease and please confirm if the City of Loveland will deliver <br />water in 2003. <br />2) The total of 11 shares of Hill & Brush Ditch stock are proposed to be committed to be used to cover <br />groundwater evaporation in the unforeseen event, or events, that would lead to the abandonment of <br />the pit. The 11 shares of Hill & Brush Ditch stock represent an estimated 49.5 acre-feet of average <br />annual historic net stream depletions. This would cover the estimated annual net evaporation of <br />2.67 acre-feet per acre on a maximum of 18.5 acres. Currently it appears that approximately 32 <br />acres have been, or are being mined. Typically, this would require additional water to be dedicated <br />to cover this additional 13.5 acres, a requirement that the 13.5 acres of the mined area be backfilled, <br />or a requirement that a bond be provided to line or backfill 13.5 acres to reduce the maximum open <br />pit area to 18.5 acres. Piease advise which of the above options may be possible in this case. <br />3) The original application (receipt no. 437309) for a well permit needs to be resubmitted to this office. <br />A copy of the application is enclosed for your reference. Please identify if there are any existing <br />wells located within 600 feet of the groundwater exposed in the pit. A hearing may be required prior <br />to issuance of a well permit if there are existing wells located within 600 feet of the groundwater <br />pond. This hearing may be waived if you are able to obtain statements from the owners of all wells <br />within 600 feet, verifying that they have no objection to the proposed well permit. <br />Once this additional information is provided, I will continue the evaluation of this request for a <br />substitute water supply plan. I apologize again for the delay in processing and appreciate your patience <br />with this matter.
