Gepi. ct h'rm~l h~>,ources <br />On September 19, 1983, Snowmass Coal Company finally received a 404 permit <br />from the Army Corps of Engineers to build weirs in North and Middle Thompson <br />Creeks. In addition, a permit from the Colorado Department of Health, Water <br />Quality Control Division, was received the same week. <br />A stipulation put into the states permit eras that we would follow all <br />recommendations made by the Colorado Division of Wildlife. Most of the recom- <br />mendations made by the Division of Wildlife were of no consequence to completing <br />the weirs this year; however, Jim Goodyear from the Division of Wildlife told <br />me that no construction could take place from October to April due to fish <br />spawning and migrating. This gave us a total of seven working days to construct <br />all four weirs from the time all the permits were issued. <br />I called Mr. Goodyear and asked if we could be allowed to construct the <br />weirs during the month of October. He stated that since the impact on the creeks <br />was small, he would allow construction of the weirs until October 10, 1983; but <br />we must pull out the 10th so that there would be a weeks time go by before the <br />start of the elk hunting season. <br />Since the time we have been alloted in which to build the weirs is short, <br />Snowmass has begun contruction of the two weirs on North Thompson Creek. We <br />feel that there may be a reasonable chance to have both weirs constructed by <br />October 10, 1983. However, it will be impossible to build the two weirs on <br />Middle Thompson Creek by this deadline; therefore, Snowmass Coal Company requests <br />that the Division allow the deadline to construct the two weirs in Middle Thompson <br />Creek be extended until October 1984. <br />Please advise me of your decision as soon as possible.
