6. Please revise the mining plan and map to show and detail any stormwater control structures <br />proposed to treat and regulate stormwater discharge from this site. <br />7. Please specify the proposed depth for the wash plant settling ponds and commit to maintain a <br />minimum 2 foot freeboard in these ponds to minimize potential for over-topping and unauthorized <br />discharge during significant precipitation events. <br />8. Please submit a weed control plan to address all noxious weeds that may be found on site, including <br />Russian olive and tamarisk. With this site being primarily dry, the wash plant settling ponds and any <br />stormwater collection area will need to be the focus for Russian olive and tamarisk control. <br />EXHIBIT E -RECLAMATION PLAN <br />9. DMG does not accept the 'Specific Development Permit for the gravel, with future use as residential <br />subdivision' pit as reasonable assurance of the residential land use. Generally, this would require <br />an approved subdivision plat and documentation that funds have been set aside for this <br />development. If, in the future, these documents become available then the Benson Brothers can <br />seek a warranty reduction. Until that time, DMG will require that an alternate reclamation plan also <br />be included in Exhibit E. This alternate plan must provide for revegetation of the site as required by <br />Rule 3.1.10 and include costs for this revegetation plan in Exhibit L. <br />DMG recommends drill seeding a mix that includes a few drought and salt tolerant grasses as well <br />as some seeds from the native shrubs such as four-wing saltbush, shadscale, and rubber <br />rabbikbrush. Mulching at a rate of 1 ton per acre, crimped is also recommended. <br />10. Please revise the reclamation plan and cost estimate to include a task for ripping, to a 1 foot depth, <br />all areas where topsoil is to be replaced. The ripping should be performed immediately prior to <br />topsoil replacement. <br />EXHIBIT G -WATER INFORMATION <br />11. Please commit to use of water from an appropriate and legal water source until the pending water <br />right from the canal is issued. Please identify this alternate water source. <br />EXHIBIT L -RECLAMATION COSTS <br />12. Please revise the reclamation costs as required for items noted above. DMG will calculate a <br />reclamation cost estimate upon receipt of your responses. <br />EXHIBIT P -MUNICIPALITIES WITHIN TWO MILES <br />13.
