Your letter described the pond as
being properly maintained and operational prior to the snowmelt. Temperature charts were included demonstrating a
fluctuation in temperature prior to the sampling event. Sampling was conducted on April 1, 2002 at approximately 11:00
a.m. a[ Outfa11004A. A ten-year, 24-hour event at Coloywo Coal Company is approximately 1.40 inches. Your sediment
ponds are designed to contain a 10-yeaz/24-hour precipitation event. The self-monitoring data you provided on your
Discharge Monitoring Report is shown below:
Repotted Permit
Period Outfall Parameter Results Conditions
2Q02 004A TSS (mg/1) 100 (30 day avg) 35 (30 day avg)
2Q02 004A TSS (mg/I) 100 (daily mx) 70 (daily mx)
2Q02 004A Iron, Total (mg/1) 12.3 (30 day avg) 3.5 (30 day avg)
2Q02 004A Iron, Total (mg/1) 12.3 (daily mx) 7.0 (daily mx)
Colowyo Coal Company has demonstrated that discharge occurred within 48 hours after measurable snowmelt and that
discharge from Outfall 004A was beyond control. Therefore, we believe that Colowyo Coal Company qualifies for the less
than or equal to a 10-year/24-hour precipitation alternate limit, thus waiving total suspended solids and total iron.
If you have any further questions regazding this matter, please contact me at (303) 692-3603.
Sin €rel~, n
Carla J.
