10. Originally only Weld County was specifically notified regarding County Line Road as they <br />are responsible for maintenance of the structure. A letter and a structure agreement <br />have been sent to Lorimer County Engineering for the same structure. Once their <br />response is received, it will be forwarded to the DRMS. If an agreement is not reached, <br />a geotechnical slope stability analysis will be provided demonstrating adequate structure <br />protection. <br />11. Regarding the agreement with Weld County for County Line Road, the 80-feet distance <br />in the agreement is correct. The distance between the limits of excavation and the road <br />is shown on Exhibit C-2 for the road, Structure 8, as 81 feet. The font has been sized <br />consistent with the others to clarify this measurement. The 70-feet half-right-of-way <br />distance is merely the half-right-of-way. <br />12. It should be noted that a notarized clearance letter from PVREA for all structures within <br />200 ft of the affected area was submitted with the original application. The subsequent <br />letter from James Byrne has been reviewed and Mr. Byrne was contacted on February <br />6, 2007 for clarification. He simply requested the operator maintain access to all PVREA <br />utilities.
