12. Regarding the agreement with Weld County for County Line Road, the 80-feet distance in <br />the agreement is correct. The distance between the limits of excavation and the road is <br />shown on Exhibit C-2 for the road, Structure 8, as 81 feet. The font has been sized <br />consistent with the others to clarify this measurement. The 70-feet half-right-of-way distance <br />is merely the half-right-of-way. <br />13. It should be noted that a notarized clearance letter from PVREA for all structures within 200 <br />ft of the affected area was submitted with the original application. The subsequent letter <br />from James Byrne has been reviewed and Mr. Byrne was contacted on February 6, 2007 for <br />clarification. He simply requested the operator maintain access to all PVREA utilities.
