Dear Mr. and Mrs. Sanders:
The Fountain Sand and Gravel Company has made application to the
Colorado Mined Land Reclamation Board (CMLRB) for a permit t mine
sand and gravel in portions of the NE 1/4 NE 1/4 Section 5 t e
NW 1/4 NW 1/4 Section 4 in Township 21 South, Range 64 West f the
6th P.M., and the SE 1/4 SE 1/4 Section 32, the SW 1/4 Secti n 33
in Township 20 South, Range 64 West of the 6th P.M., all in ueblo
County, Colorado.
As a condition precedent to the granting of such permit, the
regulations of the CMLRB, Rule 1.56 (5), require the permitt a to
have an agreement with those persons having an interest in s'gnificant,
valuable and permanent man made structures within two hundre (200)
feet of the affected land to compensate such persons for any damage
occurring to said structures as a result of permittee's mini g
activities.
You are an abutting landowner whose real property lies east ~f a
portion of the permit area in SW 1/4 Section 33, T20 S, R64W and a
mobile home is located on your property.
Therefore, in consideration of the granting of a mining permi
Fountain Sand and Gravel Company by the CMLRB, Fountain Sand
Gravel agrees to indemnify and hold addressees harmless from
against all damage or loss to said structure located on such
abutting property resulting from the mining activity conducts
the Fountain Sand and Gravel Company.
