Box 2905 <br />Durango, Colorado 81301 <br />Dear Sirs: <br />I am the owner of the surface of the land on which is <br />located the access road from La Plata County Road 120 to the <br />surface facilities of the King Coal Mine, operated by National <br />King Coal, Inc. This road is located generally in Sections 29, <br />30, and 32, Township 35 North, Range 11 West, New Mexico <br />Principal Meridian. <br />I have used this road for many years for access to my <br />nearby grazing lands and wish to continue to use it for that <br />purpose. My use of the road, both past and future, has been <br />and will be unrelated to operation of the King Coal Mine. <br />Therefore, when the King Coal Mine operation is <br />completed, I wish for the access road to remain intact and not <br />to be reclaimed. I understand that the government reclamation <br />authorities will approve a reclamation plan for the King Coal <br />Mine which calls for leaving the access road in place upon the <br />request I made above as owner of the land surface.
