Koblitz <br />Greystone <br />5990 Greenwood Plaza Blvd. <br />Englewood, CO 80111 <br />RE: Chemical Review <br />Picketvrire Processing, LLC -New Elk Mine <br />CDPS No. CO-0000906 <br />Las Animas County <br />Dear Mr. Koblitz: <br />The Division has reviewed your request far use of a chemical in waters that will or may be discharged to <br />waters of the state from [he above referenced facility. ~ <br />• Neleo 7888 Clarlftcation Aid: The aquatic toxicity data supplied in the Material Safety Dr[a Sheet <br />(MSDS) for this chemical show that it is essentially non-toxic to slightly toxic to aquatic life. The proposed <br />application rate is 50 ppm. The only aquatic species that appears affected at this rate is Ceriodanhnia <br />dtlbl8. Since the chemical is a flocculant, Inos[ of i[ is expected to remain with sludge and not be <br />discharged with the effluent. So, it is likely that the concen[ration in the dischazge would be nontoxic to this <br />species as well. <br />On this basis, it is acceptable for use in wastestreams that may be discharged to state waters. We will approve <br />this chemical for use at application rates recomtttended by the manufacturer.
