• the NFPA. Two portable fire extinguishers, or the equivalent, shall be provided at each <br />of the following combustible liquid storage installations: near each above ground or <br />unburied combustible liquid storage station; and near the transfer pump of each buried <br />combustible liquid storage tank. <br />Firefighting equipment shall be continuously maintained in a usable and operative <br />condition. Fire extinguishers shall be examined at least once every six months and the <br />date of such examination shall be recorded on a permanent tag attached to the <br />extinguisher. One portable fire extinguisher shall be provided at each location where <br />welding, cutting, or soldering with arc or flame is performed". <br />The Western Surface Agreement of 1987 of the International Union of United Mine Workers of <br />America also requires annual retraining of miners in the instruction of fire warning signs <br />and firefighting procedures. <br />Peabody Coal Company is in compliance with and conducts all required MSHA and UMWA courses <br />as stated in the law and contract, respectively. <br />1, 11 <br />u <br />Health and Safety <br />Seneca II-W Mine falls under the Federal Mine Safety and Health Act of 1977, PL 95-164. <br />The Mine Safety and Health Administration, the enforcement agency, is a part of the U.S. <br />Department of Labor. MSHA is required to inspect and enforce the Code of Federal <br />Regulations Title 30, which includes Parts 48, 50, 71, and 77. <br />Part 48 sets forth the requirements for obtaining approval of training programs and <br />specifies the type of training including new employee orientation for non-experienced <br />miners, orientation of newly employed experienced miners, annual refresher course for all <br />miners, hazard training for non-employees coming onto mine property, and task training for <br />employees who are assigned new jobs temporarily. <br />Part 50 requires operators to file reports pertaining to accidents, occupational injuries, <br />and occupational illnesses, as v+ell as employment and coal production data, with MSHA, and <br />requires operators to maintain copies of reports at relevant mine offices. The purpose of <br />. this Part is to implement MSHA's authority to investigate, and to obtain and utilise <br />information pertaining to accidents, injuries, and illnesses occurring or on ginating in <br />mines. <br />5 <br />
