However, this inctdein, <br />along with other WET data, will be evaluated by the Division and may farm the basis jot reopening the <br />permit and including additional WET limits or other requirements. <br />4J Genera! Information: The permittee should read the WET testing sections of Part /.A. and I.B. of the <br />permit carefully. The permit oinlines the test requirements and the required follow-up actions the permiaee <br />must take to resolve a tosiciry incidein. The permittee should read, along with the documeins listed in Part <br />f.B of the permit, the Colorado Water Oualirv Control Division Biomonitorine Guidance Doeumein. dated <br />!u!y 1, 1993. This document outlines the criteria used by the Division in suds areas as graining rclieffrom <br />WET testing, modifying test methods and dutnging test species. The permittee should be aware that some of <br />the conditions outlined above may be subject fo drange ijthe fadliry tsperienees a d[ange in disdwrge, as <br />outlined in Part ILA.1 of the permit. Sudt dranges shall be reported to the Division immediately. <br />5J Outfall 002: Because this ainfall consists afdomes~ic effluein with no industrial rontribtuion and because <br />the drsrharge does not go directly to State waters, WET testing is not a requirement for this outfalL <br />However, the Division reserver the right to reopen the permit to include WET testing, should jad(iry <br />conditions change or if new information becomes available. <br />4. Srormwater• Because the Division already combine coverage ojrhe site of the Tweinymile Coal Company Foide! <br />Creek Mine operation and the site ojrhe Cyprus Yampa Coa! Corporation's Mines 1, 2 3 South and Edmtan Park <br />Mine operations under the General Stormwater Permit for Mining Activities, the permittee has requested that the <br />general permit coverage coininue. This wiU be grained, ar a reruG no stormwater requirements will be roinained <br />in this permit. <br />5. Economic Reasonableness Evaluation: Section ZS-8-503(8) of the revised (June 1985) Colorado Water Oualirv <br />Control Act required the Division to 'determine whether or not any or all of the water quality standard based <br />• ejjluein limitations are reasonably related to the eroromie, environmental, public health and energy impacts to the <br />public and affected persons, and arc in furtherance ojrhe policies sa forth in sections 25-8-192 and 25-8-104.' <br />the Regulations for the State Disdtarge Permit System, 6.1.0, further define this requiremntt under 6.12.0 and <br />state.• 'Where eronomic, environmeinal, public heath and energy impacts to the public atd affected persons have <br />been considered in tha clarsifrcations and standards setting process, permits written to meet the standards may be <br />presumed to have taken iino consideration eronomic factors un4ss: <br />aJ Anew permit rs issued where the disdtarge was not in aistence at the time ojrhe class cation and standards <br />rulemaking, or <br />bJ In the care of a continuing durharge, additional information ar jactars have emerged that were not ainidpated <br />or considered at the time of the class~cinion and standards rulemaking. ' <br />The evaluation for this permit shows that the Water Quality Comrol Commission, during their proceedings to adopt <br />the CiarsiJication and Numeric Standards for the Upper Colorado River Basin, considered eronomie <br />reasorwbleness. <br />Funhermore, this is not a new disd[arger and no new information has been presented regarding the clav~cations <br />and standards. Therefore, the water quality standard-based e~Iuein limitations of this permit are detnmined to be <br />reasonably related to the economic, environnteinal, public health and energy impacts to the public and affected <br />persons and are in furtherance of the policies set forth in Sections ZS-8-102 and 104. If the permittee disagrees <br />with this finding, pursuant to 6.12.0(1)(6) the permittee should submi[ all pertinent information to the Division <br />during the public notice period <br />• <br />
