If under either <br />plan it became necessary to utilize the road through the town of <br />Whitewater, the road would have to be rebuilt to allow for heavy <br />truck usage. This would be an additional cost to the area residents. <br />We believe the above objections are sound and reasonable. It is <br />our desire not only to protect our property values but to protect <br />the living environment around us. Furthermore, we do not intend to <br />stop the applicant from using his land but only ask that you protect <br />us from such uses that would be a detriment to us. If the board <br />feels it cannot consider the issues presented by us in granting <br />a permit and make them part of any permit issued, we would request <br />the board grant a hearing on this application and consider this <br />such a petition for a hearing under Section 2.35 of the Rules and <br />Regulations of the Colorado Mined Land Reclamation Board. <br />As Ear as any future hearings on this application are concerned, <br />we would like to be considered interested parties pursuant to the <br />statute and your regulations and would hope that you would notify <br />us as to when you intend to take any action on this permit. We would <br />like to play a part in the decision making process as a concerned <br />citizen and property owner in the area to be effected. We would ask <br />that you consider all of our proposals and review those concerns <br />we have expressed before granting any permit. We would ask that <br />you consider the applicant's request for the alternate plan of <br />development, which is labeled 1(a). We believe this to be the <br />more sound approach.
