The following descriptions identify and describe the documents upon which Oxbow Mining, LLC bases its legal right to enter and begin coal-mining operations. Information on ownership and right of entry is included in Exhibit 2.03-E1, Ownership and Right of Entry documentation. None of the existing rights are the subject of pending litigation. Fee Ownership Surface Lands Deeds from Kaiser Coal Corporation to Somerset Mining Company dated December 1, 1989. Deeds from Somerset Mining Company to Pacific Basin Resources, a Division of Oxbow Carbon & Minerals, Inc., dated August 31, 1995.
